Terms & conditions

Introduction

This Agreement is made between us DAD UK Ltd and you, the person, firm or company when purchasing a DAD product. These conditions apply to all our sales and any variation to these conditions shall have no effect unless expressively agreed in writing and signed for by one of our authorised staff. These Terms and Conditions will override and take place of any other terms and conditions contained in any document or other communication used by you.

Pricing and orders

  1. All prices given are Nett and subject to VAT at the current rate. Prices and information given in catalogues, prospectuses and price lists shall not bind us in a formal manner.
  2. Nett Prices quoted exclude postage and packaging / courier charges.
  3. Cancellation of a duly registered order must be received in writing at DAD within 3 working days from the date of order. After this time the order will stand and payment in full will be due unless otherwise agreed with DAD in writing by an authorised member of staff.
  4. No orders for special items such as banks or doors may be cancelled under any circumstances.
  5. DAD Ltd will not be held responsible for quoting incorrectly when requested verbally. All orders must include the quote reference and a copy of the quote with any special drawings which may have been supplied originally. These must be signed off as correct. Failure to do so will result in DAD manufacturing as per the drawings and DAD will take no responsibility should the order be incorrect. Bank or Door orders will be manufactured as per the details on our quotations unless otherwise specified.
  6. DAD will not place or quote for goods on the basis of 'as previously supplied' or 'as per order...'.
  7. DAD takes no responsibility if the goods supplied have been ordered incorrectly and reserve the right to charge a 40% restocking charge on any individual products purchased from us.

Proforma accounts

For all orders being placed on a Proforma basis, must be paid in full within 7 days from the date of order. Failure to receive payment will result in the order being cancelled unless agreed otherwise in writing.

Payment Conditions and Retention to Title

  1. For Trade Accounts all invoices must be paid in full by BACS, cheque or credit card 30 days from date of invoice, unless otherwise agreed in writing.
  2. The invoice total must be paid in full without further discount being taken.
  3. DAD reserve the right to charge interest on overdue payments.
  4. Title to the goods shall not pass until full payment has been received. Until the title and property for the goods passes to the customer, we may at any time, without prior notice to the customer, repossess and resell the goods.
  5. For the purpose of exercising our rights, we, our employees or agents, accompanied by such vehicles or plant that the company may consider necessary, shall be entitled at any time, without prior notice to the customer, to free and unrestricted entry upon the customer's premises, or such other locations where the goods may be located for repossession.

Deliveries and Carriage

  1. Orders for normal stock items over £200 will be delivered carriage paid on a 3 day service. (UK Mainland Only) Orders under £200 will incur a carriage charge of £9.90 for 3 day service (UK Mainland Only) or £12 for a Next Day service (England and Wales only). Unless otherwise specified goods under £200 will be sent on a 3 day service.
  2. Carriage charges for outside UK Mainland i.e. Highlands, Channel Islands, Isle of Man, Northern Ireland, Republic of Ireland and all off shore destinations are available on request.
  3. We reserve the right to package goods in the way we see fit. Should you have specific packaging instructions DAD Ltd reserves the right to charge extra for this facility.
  4. Carriage for replacement spare parts such as keys and cylinders is £4.95 sent by Royal Mail Recorded Delivery for which no POD is available. Alternatively a Next Day Courier service is available at £6.90.
  5. Delivery times are given for information purposes and are to be used as a guideline only.
  6. DAD accepts no responsibility for cases of delayed deliveries or mislaid items either on site or through the courier service. Delivery times quoted are in working days or weeks, and do not take into account Factory Shutdown or Holidays. Please consult us for details on these dates when placing an order.
  7. If a carriage option is not specified on your order goods will automatically be sent via Royal Mail or a 2-3 days service dependant on product purchased. Carriage is chargeable on all banks of mailboxes according to size of pallet and number of banks ordered unless otherwise specified: POA

Finishes

All our goods are available in a wide range of various finishes. If powder coated, the RAL colour reference number needs to be specified on the order. A standard RAL colour chart is available upon request.

Damages & shortages

  1. On arrival all goods must be inspected carefully at the place of destination for any damages whether on packaging or to the goods themselves and then signed for as 'Damaged' if a claim is to be made. 'UNEXAMINED OR UNCHECKED will not be acceptable as a conditional signature.
  2. All claims for errors, omissions, shortages or damages must be communicated within 3 working days of receipt of the goods at the place of destination specified on the order. This must be confirmed in writing. Notification and photographic evidence is strictly required within 3 days to authorise a replacement or refund. If notice is not given within 3 days no credit or replacement will be given. Replacements where applicable will be within 2-3 working days UK mainland only (longer for certain products).
  3. DAD takes no responsibility for any damages caused when the order has been collected from your premises or delivered from your premises to your customer.
  4. You must keep all packaging until goods have been checked for damages. Damaged goods must not be installed, if they are then any claim for damages will not be processed as they have been deemed acceptable to the customer.
  5. If upon checking the goods they are found to be damaged and the original packaging has been disposed of, the customer must return the goods packed up securely at their own expense. Photographic evidence may be required prior to collection. DAD reserves the right to inspect these damaged goods before any decision on replacement or repair is taken.
  6. After 3 days damaged goods can only returned to DAD on the agreement from a member of DAD Staff but will be at the customers own expense.
  7. Any further damages caused by returned goods not being packed up correctly will be chargeable to the customer. DAD cannot be held responsible for further damage caused by returning the goods to our premises.
  8. Once goods have been received back at DAD any decision taken with regards to the replacement or repair will be communicated back along with an expected delivery date and/or costing.

Returns & POD's

  1. A 40% handling charge is applicable on all returns unless otherwise agreed.
  2. If agreed, goods must then be returned within 7 days at the customer's expense after being issued with a returns note wherever required. All items must be returned in its original packaging, complete and resalable.
  3. Please ensure a copy of the original delivery note is attached. The original return cost and redelivery cost of the exchange will be borne by the buyer. Failure to abide by this condition will result in no credit being issued.
  4. If goods are returned damaged, no credit will be raised and the original invoice will stand in full.
  5. When returning goods, please ensure they are packed up securely using the original packaging supplied or use enough packaging to ensure no further damage is caused during the transit back to our premises.
  6. DAD will arrange for collection of damaged goods, repacked in their original packaging, if notified within 3 days of receiving the goods.
  7. Returned goods will not be accepted without prior agreement.
  8. Bespoke orders cannot be returned under any circumstances as these have been manufactured to the customer's specific requirements.
  9. Proof of Delivery requests must be put in writing. POD's are available only for goods delivered within the last 3 months

Guarantee & copyright

  1. Items shall be guaranteed against all manufacturing defects but excludes misuse or wear and tear.
  2. Replacement of parts acknowledged to be defective; the transport of the returned and replaced goods will be at the customer's expenses. Although designed to give the maximum safety, our locks do not afford absolute inviolability or individual exclusivity. In the event of accidental or intentional half-opening, picking with or without signs of door breaking, we cannot under any circumstances be held responsible for the consequences.
  3. A site visit and inspection by a DAD qualified representative or member of staff is chargeable.
  4. All brand names, product names, titles and copyrights used are trademarks of DAD. You must obtain permission in respect to the use of any brand name, product name, title and copyright.
